Trimurti Films sues Aditya Dhar over alleged unauthorised use of a classic song in Dhurandhar 2. The dispute is now in the Bombay High Court. Here's what happened.

Dhurandhar 2 is breaking several box office records and winning the audience's hearts. Recently, it crossed ₹1000 crores in the Indian collection. Meanwhile, controversies are continuing to follow it due to many reasons. Why does Trimurti Films sue Aditya Dhar?

The production house filed a case in the Bombay High Court, as they allege unauthorised use of the iconic song Tirchi Topiwale in Oye Oye’s song.  According to Bar and Bench, the disputed track originally appeared in the 1989 film Tridev. It was composed by Kalyanji-Anandji with lyrics by Anand Bakshi.

Trimurti Films claims ownership of the composition and sound recording. It also argues that the song's version resembles one that was used without the proper license.

The company alleges that the version of this song has been used in the film without getting the necessary permission or licenses. The issue comes to light when Dhurandhar 2 is already enjoying a successful run in the theatres. 

Allegations of copyright infringement

Trimurti Films has accused the makers of Copyright Infringement. It also alleges that the recreated version of the song appears in the film’s track Rang De Lal with new vocals and arrangement. 

The plea of Trimurti Films sues Aditya Dhar argued that the use of the song amounts to unauthorised reproduction and public communication of copyrighted material. On top of that, the lawsuit also highlights how the songs are being used across theatrical releases, digital platforms, and promotional campaigns. 

Interestingly, Shashwat Sachdev is the composer of the recreated version. He added new lyrics and vocals to suit the narrative of the film. Despite the new changes, Trimurti Films argues that the composition stays identifiable and protected under copyright.

Legal demands and possible impact

The case of Trimurti Films sues Aditya Dhar filed in the Bombay High Court demands an immediate order to stop the use of the song. The company also demanded damages and other legal remedies. 

If the court's ruling comes in favour of Trimurti Films, it might lead to big changes to the film’s distribution. It means it could result in the possible edits or removal of the songs from future releases. 

Such cases are not new in the entertainment industry, as here rights over music and intellectual property usually lead to disputes. Meanwhile, the scale of this case is big because of Dhurandhar’s commercial success and wide reach.

Right now, there has been no detailed public response from the makers related to the allegations. The result of the case might influence how recreated songs should be handled in future Bollywood projects.
